District Attorney John Zakowski says prosecutors would have a difficult time proving Jose Torres caused the accident that took the life of 20-year-old Krista Metsa.
Zakowski says Torres ``created his own prison term in being a quadriplegic.''
Torres was driving the motorcycle that crashed last September. Metsa was on the back.
Torres was initially charged with homicide by intoxicated use of a motor vehicle.
He pleaded guilty to operating while intoxicated-first offense, an ordinance violation that carries a $708 fine.
