LuAllen H. Kettner is accused of driving a Ford Excursion that struck and killed 47-year-old Leo Kuisle of Stewartville at 7 a.m. May 15.
Kettner was charged Tuesday with failing to drive with due care and following too closely, both misdemeanors.
Reached Tuesday at his home, Kettner said he's been advised not to comment on the charges at this time.
At the time of the accident, prosecutors said the flagman was trying to control traffic as a large bulldozer was crossing the road.
Since the accident, that section of the highway has been renamed Highway 61.
MnDOT has said Kuisle was the 31st MnDOT employee to be killed in a work zone since 1960.
