A 58-year-old Tomah man has been referred to the Monroe County District Attorney for third-degree sexual assault and soliciting prostitution.

Mark Clay was arrested after a visibly distraught woman told police that Clay assaulted her at his residence. The woman said Clay had deposited money in her account while she was prisoner in the Monroe County Jail in Sparta and picked her up at the jail the day she was released. She asked Clay to drop her off a friend’s house, but he drove her to his Kilbourn Avenue residence instead, according to the report.

The woman said they went into Clay’s residence and that he directed her into his bedroom, where he told her to remove her clothes. She told Clay the request made her uncomfortable but complied because she was afraid of him.

The woman said Clay performed oral sex on her even though she told him it made her “uncomfortable.” She said Clay then told her get on top of him, and he performed sexual intercourse on her. She said she tired pushing away but that Clay grasped her thighs to pull her down. She said she left the residence when Clay entered the bathroom. She was transported to Gundersen Hospital in La Crosse for a medical exam.

Police obtained a search warrant for Clay’s residence. After several unsuccessful attempts to breach a heavy metal door, police observed Clay leaving through a garage exit and arrested him without incident. A search of Clay’s residence allegedly found evidence that he provided drugs, cigarettes and housing to women in exchange for sex acts.
