A 44-year-old Warrens man has been referred to the Monroe County District Attorney for a crash that killed a passenger in a vehicle he was driving in the village of Warrens July 23.

Yancy Kevin Deiter was referred in the crash that killed Keith Wayne Nelson, 69, Warrens. Dispatch reported that a car had rolled over at the intersection of Hwy. EW and Jellystone Drive and that the driver, later identified as Dieter, was crawling outside the vehicle with a broken leg. When police arrived, Nelson was dead at the scene, and Dieter was lying on his back near the vehicle.

According to the report, Dieter told police he believed the crash had occurred three hours earlier but he remained in the vehicle because he didn’t know what to do. A witness who was camping at Jellystone Park told police he heard a loud crash at 1:55 a.m. but couldn’t see anything in the dark. The report says the vehicle broke through at least three trees and damaged an underground telephone cable box.

Deiter was taken by ambulance to Tomah Memorial Hospital, where he reportedly refused a blood test.

Deiter was referred for negligent operation of a vehicle causing death, operating after revocation causing death and reckless driving causing bodily harm. He was issued citations for failure to keep a vehicle under control, operating without insurance, seat belt violations for both driver and passenger and operating left of center.
