A La Crosse man accused of raping a woman who was too drunk to consent to sex could face prison time.
David E. Davis, 38, was charged with second-degree sexual assault Friday in La Crosse County Circuit Court. The charge carries a maximum fine of $100,000 and a maximum prison sentence of 40 years.
According to the criminal complaint:
The alleged victim met Davis at Legend's Bar on July 27, recognizing him from Facebook. They stayed at Legend's until bar close, at which point the woman's friend invited the pair to her apartment.
The woman told police that, after arriving at her friend's apartment, she felt as if the room were spinning and that she needed to throw up.
Davis grabbed the woman, removed her clothes and raped her, she said. The woman said she resisted and asked him to stop multiple times.
Davis has been accused of similar crimes in the past.
In October 2016, he was charged with first-degree sexual assault, aggravated battery, strangulation and disorderly conduct after allegedly raping a woman and inflicting an injury so severe that it left her blind in one eye.
The charges were dismissed by prosecutors under due diligence, though the case may be reopened.
