An Onalaska, Wis., teen on Tuesday received a year in jail and 10 years probation for having sex with a 13-year-old girl in September.
Sean Harnisch, 17, had pleaded guilty in November to second-degree sexual assault and fourth-degree sexual assault. He admitted fondling a 12-year-old girl and having intercourse with a 13-year-old girl in Onalaska's Rowe Park on Sept. 10.
La Crosse County Circuit Judge Michael Mulroy said he came into Tuesday's sentencing prepared to send Harnisch to prison but changed his mind after hearing the arguments from Assistant District Attorney Julie Nelson and defense attorney Theodore Skemp.
"The way I see it is I'm giving you one last chance to screw up," Mulroy told Harnisch, who could have received 30 years in prison on the more serious sexual assault conviction. "I know that isn't a very judicial way to put it, but that's the way it is."
Harnisch, who has a lengthy juvenile record, also pleaded guilty to criminal damage to property, felony bail jumping and misdemeanor bail jumping.
Mulroy sentenced Harnisch to concurrent probation time on the other charges.
