A 19-year-old Sparta man has been referred to the Monroe County District Attorney for two alleged sexual assaults involving minors.
A girl told police she had sexual intercourse with Daniel R.E. Matern in fall 2016 when she was 15 and he was 18. The girl told police that she and another girl, who was 16 at the time, went to a party in downtown Sparta, where the 15-year-old became drunk and vomited on herself. She said another person at the party pulled her pants off and put a pair of basketball shorts on her.
The 15-year-old said she drank some more alcohol before she laid on a bed. She said Matern crawled into the bed and had sexual intercourse with her. She said Matern didn’t force himself on her and that she could have gotten up and walked away had she chosen.
The 16-year-old told police that Matern was badgering both girls to drink alcohol and that he “forced himself on me” the same night he allegedly assaulted the 15-year-old.
Matern was referred for second-degree sexual assault of a child and sexual assault of a child 16 or older.
